  6. WHO CAN YOU PAY YOUR ZAKAATUL MAAL TO? 1. The poor (miskeen). The miskeen are described as those people who do not have enough to eat today, do not have adequate clothing today or do not have adequate shelter today. If they lack any of these three ‘survival needs’, they are considered to be miskeen. 2.The needy (faqir). The needy are people who have all their survival needs satisfied, but are short of money (and therefore ‘needy’) when it comes to providing healthcare, necessary education and necessary travel costs for themselves and their family. 3.The wayfarer (literary ‘son of the road’) is the traveller who is stuck in a land more than fifty miles from home and does not have enough money to get home. The refugees like the Rohingya Muslims of Burma and those fleeing the atrocities in Syria can come under this category or the two categories above. 4.Those employed in collecting zakaat. The duty of collecting the zakaat is for the head of the Muslim community worldwide (Amirul Mu’mineen). Traditionally he would appoint qualified and trustworthy people to collect zakaat on his behalf. They were known as ‘amaleena ‘alaih’ and they were eligible to be paid for their efforts from the zakaatul maal funds. Today the question arises, who will appoint the zakaat collectors? Can we appoint ourselves to collect zakaat and pay ourselves out of the zakaat money? Scholars and Charity Organisations, unfortunately, cannot agree on what should be done and have adopted different solutions to this problem. The first opinion is that until we have a khalifah nobody can appoint zakaat collectors and they cannot be paid from the zakaat funds. Muslims should deliver the zakaat to the eligible people themselves or delegate individuals to do so on their behalf (these delegates cannot be paid from the zakaat money). The second opinion is that we cannot wait for a khalifah as many Muslims around the world are in urgent need, so Charity organisations appoint zakaat collectors and they are paid from the zakaat money. The third opinion is that Charity organisations will appoint people to collect zakatul maal but will not pay these workers from the zakaat money. Eaalim Institute supports Ummah Welfare Trust, who follow the third opinion and have a policy of 100% of donations reaching the needy people. They do not use zakaat money for their administrative costs or to pay their employees salary or travel costs. At the moment there are few charities, which have a 100% donations policy, but we hope that this increases in the future. Al Imdad Foundation UK is another charity which collects and distributes zakaat with a 100% donations policy. 5.Those whose hearts are to be reconciled. This category includes people who are very close to accepting Islam and are needy and people who have recently accepted Islam. This payment is to remove hardship from these people as they may have made a huge sacrifice which could include facing boycott and persecution from their families. The payment will make their hearts incline further towards Islam and prevent them from returning back to their non-Muslim communities if the hardship is too great. 6.For freeing slaves. Zakaat money was paid to help Muslims who were in slavery to buy their freedom. In the past when the Islamic state was prosperous, and the zakaat fund was large with few Muslims in the Islamic state needing zakaat payments, Muslim rulers would use the zakaat funds to buy the freedom of slaves in neighbouring countries. In some cases these slaves would embrace Islam. This category includes paying the ransom for freeing prisoners of war. 7.Those in debt. A Muslim who is not able to pay his debts and is under pressure from his debtors is allowed to take zakaat money to pay off his debts. He is not allowed to spend this money on himself or his family, but to give it direct to his creditors. Today there are many Muslims whose lives are akin to slavery because of debt especially in the Indian Subcontinent. These people would be eligible for zakaat money. 8.Those in the way of Allah. In the past, ‘fi sabi lillah’ or ‘in the way of Allah’ was interpreted to mean those who are fighting to make the word of Allah highest in the world[1]. In recent times, many scholars have interpreted the meaning of ‘fi sabi lillah’ more widely to include Islamic schools and organisation that propagate Islam[2] such as Peace TV. As with many issues, the scholars disagree and debate continues, although most scholars agree that Masjids cannot be included in this category. I hope that Allah (Glory be to Him) increases the knowledge and understanding of the Muslims worldwide and our ability to help each other when we are most in need. Today we need to help our brothers and sisters in prisons (many without charge or trial) in the United States of America and Europe and those fleeing the terror in Syria and Burma.   7. PURIFYING YOUR WEALTH BY PAYING ZAKAATUL MAAL The Prophet (Peace be upon him) explained that Islam is built upon five pillars[1]: 1. Testifying that no one has the right to be worshipped but Allah and that Mohammed is the messenger of Allah. 2. Praying five times every day. 3. Fasting the month of Ramadan every year. 4. To pay zakaat (literary purification) on wealth above the nisab (85 grams of gold or 6 ounces of silver or the equivalent value). 5. To make pilgrimage to the House of Allah in Makkah once in your life if you are able to. Although the laws of Islam are many covering every aspect of a person’s life, the above five rules are considered as the minimum a person must follow to be considered that he/she is following the Shariah. The current state of the global Muslim Ummah is that we are witnessing a revival in the practicing of our way of life. This is evident from the conversations you hear children engaging in on public buses, by the proliferation of knowledge and debate about Islam on the internet and by the attendance of young Muslims for Jum’ua and Taraweeh prayers. While all children memorise the first pillar and most observe the fasting even if they do not pray five times a day, Muslims have been neglectful of paying zakaat and many are not familiar with the rules of zakaat. There are two types of zakaat: zakatul fitr which needs to be paid at the end of Ramadan before the congregational prayer for Eidul Fitr and zakatul maal (purification of wealth). Zakaatul maal does not have to be paid in Ramadan although many wish to pay it in Ramadan in order to gain multiple rewards that Allah (swt) gives for good deeds performed in this holy month. Zakaatul maal is paid so that rich people do not lock away wealth through hoarding or saving (described in the Quran as burying gold and silver) and thereby removing it from the economy. Although Muslims are allowed to save up money for a specific purpose such as going to Hajj or buying a car, Islam does not encourage saving money for the sake of saving; money is to be used as a medium of exchange to make it easy for people to carry out the tasks necessary for living in this world, it is not to be collected, saved or hoarded like a commodity. If a rich person locks away a large amount of money in a bank account for a year or more than his actions cause harm to poor people. This is the kind of action that has caused and is still causing the current financial crisis in the world. The duty of zakaat is a way to ensure that the poor people are not harmed by the removal of wealth from being circulated in the economy. Any person who has a large amount of money that he has owned for over a complete lunar year must pay one fortieth (2.5%) of it to the six categories of people mentioned in the Quran[3] as a purification of the wealth he has saved. This is not a favour or optional charity that he his paying, rather this money belongs not to him but to those people and he is only giving them their rights. Zakaatul maal is a compulsory payment and must be calculated correctly and you must make the intention for paying the zakaat after calculating the amount and before paying it[4]. There is no harm in paying more than the calculated amount as the excess will count as voluntary charity. It is also allowed to delegate someone else to pass on the money or wealth to the deserving person. The responsibility of collecting and distributing the zakaat belongs to the khalifah, who can appoint collectors to carry out this task. Unfortunately, as the Muslim Ummah has been without a khalifah for nearly a century, many charity organisations have been set up to fulfil this obligation. The scholars disagree about the permissibility of having charity organisations as permanent zakaat collectors rather than as agents for distributing the zakaat on an ad hoc basis. There is also controversy about paying the charity workers from the zakaat money, with very few charities currently having a 100% donation policy. Some charities have been criticised for paying very large salaries to their executives and using luxury cars for their officers when distributing food and money. If you have relatives who are eligible for receiving zakaat it is better for you to arrange for your zakaat to be passed on to them rather than delegating to charity organisations. Any person who owns excess wealth to the amount of the nisab of zakaat is not eligible to receive zakaat except to pay off debts. The value of the nisab of zakaat changes with the changes of the value of gold and silver. At the start of Ramadan this year it was £2,400 for 85 grams of gold and about £450 for 6 ounces of silver[5]. If you have owned gold, silver, cash savings or a combination of the three for a whole lunar year more than the above amounts after taking away your short term debts than you must pay 2.5% of the total amount you have at the end of the year as zakaat. You can choose which nisab you calculate your zakaat on, the gold amount or the silver amount. The scholars encourage the use of the silver nisab as it means more people will pay zakaat and therefore more poor people will benefit. The scholars disagree about women’s jewellery that they wear regularly. The Hanbali scholars say that you do not need to pay zakaat on gold and silver jewellery that is worn regularly. The stronger opinion is that of the Hanafi scholars and Shaykh bin Baz and ibn Uthaimeen also agree with them; if the jewellery is made mostly of gold or silver than you need to pay zakaat on its value. If the jewellery is made from mixed metals, and the amount of gold or silver is lesser than the other metals (e.g. in the case of 9 carat gold), than you do not need to pay zakaat on it.   8. Zakatul Fitr

    ZAKATUL FITR Muslims in the UK are often surprised at the discrepancy in the rates of zakatul fitr set by different Masjids without understanding why. There is also some confusion about who has to pay zakatul fitr and who is eligible to receive it. Some scholars have said that every head of a household has to pay it [even if they end up receiving zakatul fitr later on, in order for their household to join in with the Eid celebrations!] The purpose of zakatul fitr is that on the day of Eid ul Fitr every Muslim family can have some food in the morning after a month of fasting. It is sunnah to eat something before you go to the Eid prayers on Eid ul Fitr, while it is sunnah to go to the Eid congregation without eating on Eid ul Adha. The Hadith, narrated by Abdullah ibn Umar (ra), which states that, “The Messenger of Allah, Mohammed (pbuh) commanded zakatul fitr to be paid in the form of a saa’a of dates or a saa’a of barley by all Muslims; slave, free, male and female young and old. He (pbuh) commanded that it should be paid before the people went out to pray the Eid salaat”[1] Another Hadith narrated by Abu Saeed al Khudri (ra) states that, “We used to pay zakatul fitr when the Prophet (pbuh) was alive; a saa’a of food or a saa’a of dates or a saa’a of barley or a saa’a of raisins or a saa’a of dried yoghurt.”[2] Based upon these evidences the ulema have concluded that every Muslim who is self sufficient (is not financially dependent on someone else), should pay zakatul fitr if he has one saa’a of food or more above what he needs for himself and his family on the day and night of Eid ul Fitr. It is clear that the original actions of the companions of the Prophet (pbuh) were to wait until the morning of Eidul Fitr and see what food was in their house. Then they would donate the excess food to those who were needy before going to the Eid prayer. They were living together as a Muslim community who knew each other, interacted with each other and the Prophet (pbuh) made it easy for them to discharge all their duties. Today, we face more difficult circumstances. In the Muslim lands the knowledge of Shariah laws is no longer taught to all Muslims in school and in the west we live dispersed as a minority amongst many non Muslims. This makes it difficult to know who amongst us is struggling financially and is eligible for zakatul fitr [there are many]. As a result it is very difficult to wait until the morning of Eid and ensure food reaches the needy Muslim (non Muslims are not eligible for zakatul fitr) and make it to the Eid prayer on time. To make it easier for us, some ulema recommend that we pay the money equivalent to a saa’a of wheat (about 2.25kg) in the last three days of Ramadan to our local Masjid or charity organisation, who promises to pass on the saa’a of food on your behalf. It is also allowed to pay the money any time in Ramadan as most zakatul fitr is sent abroad to third world countries where people struggle more than the Muslims in the UK. Some scholars[3] say that zakatul fitr cannot be paid in cash; it must be given in the form of food. You could send the money to a relative or organisation early in Ramadan with instructions or responsibility to buy food with this money and deliver the food in time so that the needy person can use this food to join in with the Eidul Fitr celebrations. It is too late to pay money into the Masjid collection box after the Eid prayer, and in this case you would not get the reward for paying zakatul fitr. If you did not pay it at all, you would be sinful. The scholars agree that the head of the household is responsible for paying zakatul fitr for himself and every member of his household; it is also recommended to pay for any unborn children if someone in the household is pregnant. The ulema do not agree on the price of 2.25kg of wheat, however; this is why some Masjids say £3.00 per person and others say £5.00 per person. If you understand the purpose of zakatul fitr and the way it was paid by the companions of the Prophet (pbuh), you can work out the price yourself. Another alternative is to pay directly to the needy person money for a meal (or the meal itself) to feed a person until they are satisfied for each member of your household. You can deliver it any time from the sighting of the new moon (Eid begins at Maghrib). Depending on what kind of meal you choose and where you buy it from, the cost of a meal can vary from £2.00 to £20.00! The Messenger of Allah (pbuh) also taught that if a relative is needy and eligible for sadaqaat (including zakatul mal and zakatul fitr) than he has more right on you than a non relative. Today Muslims are dispersed all over the world with western Muslims having many needy relatives living in the ancestral lands. The logistical difficulties of delivering food within a narrow time frame to relatives spread over many different cities compared to a community of Muslims living together in a small area (as Medina was in the time of the Prophet (pbuh)) means that many Muslims send cash via Western Union or even to mobile phones in some African countries. These relatives would be trusted to buy food for their own families, although this cannot be guaranteed! Some of the knowledgeable Imams on the community channels have said that this is acceptable[4]. Other scholars say that the purpose of the zakatul fitr is to help the needy to celebrate Eid ul Fitr, so it is acceptable to give it in cash; the needy person can decide if they buy food or clothes with it as he wishes. We pray that Allah gives the Ummah the ability to understand and unite on truth and Justice.   9. SHOULD ALL MUSLIMS WORLDWIDE FAST AND CELEBRATE EID ON THE SAME DAY? The Muslim Ummah today is spread around the world. There are over 60 countries with Muslim majorities while many Muslims also live as minorities on all inhabited continents. Some Muslim minority communities are larger than the populations of many Muslim majority countries. China has over twenty million Muslims and France has over five million. These communities are larger than the populations of some Muslim countries in the Middle East such as Bahrain and Qatar. All together we are between one and a half and two billion Muslims on the Earth. If we combined our finances, our voices or our military and political strengths we would be a superpower. Alas, far from this we are struggling to agree on which day Ramadan fasting begins and which Day to celebrate Eid ul Fitr and even (surprisingly) Eid ul Adha! Every year Muslims around the world eagerly await news of the moon sighting as the Prophet Muhammed (saw) said, “Fast when the moon is sighted and stop fasting when the moon is sighted...otherwise complete thirty days..”.[1] On the face of it this sounds straight forward. Everyone looks for the moon and if no one sees it we complete thirty days of Sha’ban and fast on the next; a lunar month is never more than thirty days. So why is it that every year the Muslims are split in the UK? This year is no exception. Some Muslims began fasting on Friday and others began fasting on Saturday; this will inevitably lead two some Muslims celebrating Eid ul Fitr on the same day as others are fasting what they believe is the last day of Ramadan. We know from the Messenger (saw) that it is not allowed to fast on the Day of Eid. So who is correct and who is wrong? A day cannot be both Ramadan and Shawwal at the same time! According to Professor Tareeq muneer[2], there are four methods used for deciding when to fast and when to celebrate Eid at the moment: 1.Calculating the Date of 1st Ramadan and 1st Shawwal using knowledge of Astronomy and Mathematics. 2.Calculating the ‘probable’ day of moon sighting with knowledge of Astronomy and Mathematics so that people can go out to look for the new moon on the correct day. (In some countries such as Bangladesh, people do not look for the moon on the first day, rather they look for the moon on the second or third day of Ramadan, and they see the larger and longer lasting crescent of the third of Ramadan and assume it is the new moon. This results in Muslims in Bangladesh celebrating Eid ul Fitr two days after people in the UK.) 3.Actual moon sighting. 4.Alternating the number of days in the lunar month e.g. If Muharram is decided to be 29 days then Safar is 30 and Rabiul Awwal is 29, then Rabiul Akhir is 30 and so on. Of those who use the actual moon sighting such as in Morocco, Bangladesh, Pakistan and Indonesia, there is a difference of opinion of where the moon must be sighted. The first view is that of Imam Abu Hanifa and many Hanafi scholars that came after him, as well as Ulema from other schools of Fiqh: “ If a Trustworthy Muslim [who is mature and has good eyesight and knows what the new moon looks like and where to look for it[3]] in the most eastern land sees the moon of Ramadan, then the Muslim in the most western land must fast if news has reached him about the sighting and vice versa. If the Muslim in the most eastern land sees the new moon of Shawwal, then the Muslim who lives in the most western land must stop fasting if news reaches him of the sighting.” This view is based on the Hadith mentioned above which is agreed upon, (recorded as sahih in both Bukhari and Muslim) general and addresses all Muslims; this view enhances Muslim unity. Some Ulema point out that if we can pray Jumuah salaat on the same day in every country despite time differences, then what is stopping us from doing the same for Eid salaat? The other view is that the moon must be sighted in each locality. This is held by many Hanafis in the Indian sub continent and is based on an opinion of Abdullah ibn Abbas (ra)[4], “ Kurayb (ra) reported that he saw the new moon (of Ramadan) in Syria on Thursday night. When he arrived at Madina, he learned that the new moon was sighted in Medina on Friday night...Kurayb (ra) asked Ibn Abbas (ra), ‘Don’t you consider as sufficient the sightings of Muawiyyah (ra) and his fasting (in Syria)?’ Ibn Abbas answered, ‘This is how the Messenger of Allah instructed us’ [referring to the decision of the people of Medina to fast according to their own sightings]. There is, no doubt, some political issues behind this second opinion as the size and shape of a ‘locality’ changes today with political events. It is well known that people in Sylhet used to fast when the moon was sighted in Karachi before 1971, while today they do not fast unless the moon is sighted in Dhaka. In addition it is still baffling why Muslims in London or Birmingham would split on this issue. Whatever method above you use, surely everyone in the same city should fast or celebrate Eid on the same day? Most Muslim scientists are promoting a middle path of calculating the places where it is scientifically possible and impossible to sight the moon and the ‘probable’ date and time of the moon sighting followed by actual sighting by qualified Muslims. This eliminates the problems of false reports of sightings before the new moon is ‘born’, cloudy skies preventing sighting and people looking for the new moon on the wrong day. The scholars can then debate whether one sighting is enough for the whole world or not and the Muslim leaders (of each community given the absence of an ‘Amir ul Mumineen’) can debate the size of a locality: Is the whole of Russia one locality or many localities? Is Chile one locality or many? In the mean time Muslims are advised to follow your local Masjid; if you pray taraweeh behind him, then, fast with him! Make plenty of time for Allah this Ramadan Allah (Glory be to Him) explains in the Quran that people are busy competing with each other in piling up worldly things, until they reach the graves[1]. He (glory be to Him) also says that people will come to know when they see the hellfire for themselves and are asked about every luxury and delight that they enjoyed in the life of this world[2]. In another part of the Quran Allah (The Most high) asks ‘Oh Mankind, what has made you forget your Lord the Most Generous?[3]’ It is not difficult to see how busy most people’s lives are, especially in the western world and especially in our modern time. In many families both partners are working and indeed this is the direction families are being pushed in by western governments. Despite the development of modern gadgets and technology such as mobile phones, internet shopping, twenty four hours opening supermarkets, educational TV channels, online learning and computer based Quran learning and other ‘time saving devices’, we still do not have much free time. For many Muslims around the world, it is a struggle to pray five times a day on time every day, let alone to pray in jama’ah in the masjid. Many workplaces, hospitals, stations and airports do have prayer facilities these days; more and more Masjids are being built around the world. All this makes it easier and quicker for us to fulfil our daily obligatory acts of worship. For those who want to go beyond the compulsory acts and draw closer to Allah with optional prayers and other acts of worship such as reciting Quran and giving charity, the current economic crisis is making it tougher to find spare time and money. Despite this there is a growing revival in the Muslim Ummah of learning about Islam, checking the authenticity of acts of worship and traditions and in the practice of many optional types of worship in recent years, especially among the youth. We are all given twenty four hours in every day. The rich among us and the poor among us as well as the old and the young are all equal in this respect. So why is it that some people manage to pray tahajjud every night and pray 20 rakahs of taraweeh in Ramadan, while others manage to fast in Ramadan but do not have time for even the fard salah let alone taraweeh? There are many theories and many arguments that could keep us busy for hours in response to this question. It boils down to one thing: priorities. In business management there is an important principle for effective time management: ‘Do the most important thing first’. So what is the most important thing for us? We are busy working, shopping, cooking, eating, exercising and going to the doctor’s surgery in order to maintain the health of our bodies (and minds in some cases!). What about our souls? Do we not need to make some time to nourish our souls also? In the west, the disbelievers have denied the existence of the soul and the symptoms of that disease show in the cracks in their civilization. Muslims do believe in the existence of the soul; when it leaves the body, food, exercise and the doctor can do nothing for the body. So let us make time to nourish our souls this Ramadan. Let us thank Allah that we have been blessed by reaching this Ramadan; who can guarantee to be here next Ramadan? The nourishment of the soul is to establish your relationship with Allah, to remember that he is there all the time. This Ramadan, do not forget Allah’s presence. Stand before Him in ritual prayer (salaat) when He calls. Make an appointment to be awake and speak to him during his surgery hours (the last third of the night) and ask him for what you want most; His messenger (saw) told us that he is ready to give at this time[4]. Make dua just before breaking fast; leave whatever you are doing ten minutes before, not once the adhan has been heard. Ask for something big, something you really want. Ask not just for yourself; ask for all the Muslims as Allah (The Most Generus) will not run out. Make time for Allah, learn about Him and draw closer to Him, Love Him more, Make Him the most important thing in your life. Spend time with Allah (The Most High) this Ramadan. Allah (Glory be to Him) said in the Quran that those who believe love Allah more than anything else[5].
