Question of Fatwa In a recent TV show, some lesbians and gays appeared and the announcer said that we should show some more respect to the feelings and behavior of others. He further commented that we should know how to live together and accept others. Myself, I was stunned by such words and could not utter a word. Please enlighten me on Islam’s stance and reply to such deviation.

All thanks and praise are due to Allah and peace and blessings be upon His Messenger.

 

Dear brother in Islam, may Allah bless you for this great love for your religion and search for true knowledge and purity in a world where perversion has become the norm and immorality has spread like wild fire.

 

In the first place, we would like to make it clear that sexual perversion—homosexuality and lesbianism—finds a great resort and refuge in the Western countries where it is accepted and legalized by the laws of these countries that put man in a position even worse than animals under the pretext of protecting human rights.

 

In such countries that credit civilization and progress to itself, those people are free to establish their own unions, clubs and forums where they can gather together to discuss their problems and work for further forms of perversion and deviation.

 

To accept such ignominies as a substitute for the natural human relation between males and females is no more than a big leap towards chaos and following animal instincts. The outcome of accepting such manias will be no less than more destruction, disgrace and degradation brought to the face of mankind.

 

This act of accepting such perversion is a fierce attack against the rights of women and deep involvement in filthiness.

In his book Problems of Young People: Suggested Solutions Versus Islamic Ones, Dr. `Abbas Mahgoub, states:

 

“Sexual perversion (homosexuality and lesbianism) can be traced back to the following reasons:

 

1- The lack of that kind of education that is based on a genuine flexible understanding of Islam. Such an understanding should be free from suppression, compulsion or depression. Due to the widespread misconception that all kinds of contacts between members of the opposite sex are sinful, there is a big sensitivity in this regard.

 

2- The bad friends who come from different age stages and exchange the social and spiritual emptiness.

 

 

3- The lack of proper sex education that informs young men and women about how to satisfy their innate sexual desires according to the laws established by Almighty Allah and keep themselves far remote from any kind of unnatural behavior.

 

4- The carelessness shown in meeting young people’s demands for buying anything they desire and giving them excessive freedom. Such carelessness leads them to deviate, and it is really the responsibility of fathers and mentors to enlighten their children and young people on the importance of moderation in fulfilling such needs.

 

 

5- The lack of monitoring. Parents should monitor their children without giving them extreme freedom or suppressing them. A balance should be struck between them and should go hand in hand with guidance and mutual trust and consultation.

 

6- The lack of true understanding and explanation of the physical and psychological dangers and hazards of adultery, fornication, and sexual perversion in this world and the great punishment of the Hereafter.â€

 

In the West, homosexuality is on the increase because youngsters are encouraged by society to date at earlier and earlier ages. When adolescents or even pre-adolescents are not comfortable with the opposite sex, they are not told that this is due to natural shyness at a young age but that they might be homosexual, and they are encouraged to experiment sexually with their same sex.

 

Sexual perversion, as previously stated, has two main types, namely male homosexuality and lesbianism. Following is a clear discussion of both:

First: Male Homosexuality

 

The Qur'an tells us the story of the people of Lut (Lot), who deviated from the natural way and got involved in this abnormality, refusing every word of advice from their Prophet Lut. Thus, their destiny was destruction and punishment. Almighty Allah says: “And Lo! (Remember) when he said unto his folk: Will ye commit abomination such as no creature ever did before you? Lo! ye come with lust unto men instead of women. Nay, but ye are wanton folk. And the answer of his people was only that they said (one to another): Turn them out of your township. They are folk, forsooth, who keep pure. And We rescued him and his household, save his wife, who was of those who stayed behind. And We rained a rain upon them. See now the nature of the consequence for evil doers!" (Al-A`raf: 80-84)

 

The eminent Muslim scholar Sheikh Yusuf Al-Qaradawi, states:

 

"Almighty Allah has prohibited illegal sexual intercourse and homosexuality and all means that lead to either of them. This perverted act is a reversal of the natural order, a corruption of man's sexuality, and a crime against the rights of females.

 

The spread of this depraved practice in a society disrupts its natural life pattern and makes those who practice it slaves to their lusts, depriving them of decent taste, decent morals, and a decent manner of living. The story of the people of Prophet Lut as narrated in the Qur'an should be sufficient for us. Lut's people were addicted to this shameless depravity, abandoning natural, pure, lawful relations with women in the pursuit of this unnatural, foul and illicit practice. That is why their prophet, Lut (peace be upon him) told them: "What! Of all creatures, do you approach males and leave the spouses whom your Lord has created for you? Indeed, you are people transgressing (all limits)!" (Ash-Shu`araa: 165-166)

The strangest expression of these peoples' perversity of nature, lack of guidance, depravity of morals, and aberration of taste was their attitude toward the guests of Prophet Lut (peace be on him), who were angels of punishment in human form sent by Allah to try these people and to expose their perversity. The Qur'an narrates the story: "And when Our messengers came to Lut, he was grieved on their account and did not know how to protect them. He said, 'This is a day of distress.' And his people, who had long since been practicing abominations, came rushing toward him. He said, 'O my people, here are my daughters. They are purer for you, so fear Allah and do not disgrace me in front of my guests. Is there not a single upright man among you?' They said, 'Thou knowest well that we have no right to thy daughters, and certainly thou knowest what we want.' He said, 'If only I had strength to resist you or had some powerful support!' Said (the angels) 'O Lut, truly, we are messengers of thy Lord; they shall not reach thee....'"(Hud: 77-81)

Muslim jurists hold different opinions concerning the punishment for this abominable practice. Should it be the same as the punishment for fornication, or should both the active and passive participants be put to death? While such punishments may seem cruel, they have been suggested to maintain the purity of the Islamic society and to keep it clean of perverted elements."

Moreover, Sheikh Muhammad Saleh Al-Munajjid, a prominent Saudi scholar and lecturer, adds:

 

"Islam emphatically forbids this deed [homosexual sex] and prescribes a severe punishment for it in this world and the next. How could it be otherwise, when the Prophet of Islam (peace and blessings be upon him) said: ‘Whoever you find committing the sin of the people of Lut, kill them, both the one who does it and the one to whom it is done.’ (At-Tirmidhi: 1376) That is, if it is done with consent."

 

The scholars of Islam, such as Malik, Ash-Shafi`i, Ahmad and Ishaaq said that (the person guilty of this crime) should be stoned, whether he is married or unmarried.

 

There is no doubt that this act, which goes against the pure human nature created by Allah, by making men content with men and women with women, destroying families, adversely affecting the birth rate, causing the spread of killer diseases, harming the innocent when children are raped, and generally spreading corruption on earth, should be uprooted and stamped out."

 

Thinking of the wisdom behind prohibiting homosexuality and lesbianism, the following can be said:

 

First, such acts lead to the spread of passivity among the young generation and destroy their morality, since they cannot practice such perversion except after taking some drugs to create for themselves a virtual atmosphere where they feel fake joy. Sufficient unto any person to feel that his manhood is lost.

 

Second, it destroys the lives of women whose husbands leave them in pursuit of this perversion and they, in turn, try to find a way to satisfy their sexual needs. In such case, the whole society will be no more than chaos.

 

Third, it is a fierce attack on progeny and pregnancy, which increases the human race.

 

Fourth, the dangerous diseases that are caused by it are unavoidable and fatal. Topping these illnesses is HIV/AIDS.

 

It is because of all these things that Almighty Allah prohibited homosexuality.

Lesbianism

 

As for lesbianism, it is also no more than a perversion and an attack against the natural relation between a man and a woman.

 

There is no certain punishment for lesbianism. Still, disciplinary punishment is there for any perverted person who commits it. The Kuwaiti Encyclopedia of Islamic Jurisprudence states:

 

"Muslim jurists agree that there is no certain hadd (punishment) for lesbianism. However, they agree that disciplinary punishment should be administered since it is a sin."

 

Such an act spoils the doer's character and make her testimony unacceptable, as stated in the above named encyclopedia:

 

"Muslim Jurists agree that a witness should be morally sound. A pervert cannot be taken as a witness. Since lesbianism is an act of perversion, a lesbian cannot be a witness. Even with the jurists not declaring this openly, it can still be understood from their words and conditions."

Question of Fatwa Respected scholars of Islam, As-Salamu `Alaykum wa Rahamtu Allah wa Barakatuh. I have read in a newspaper that an Iranian man who was convicted of raping and killing his 16-year-old nephew is to be executed by being thrown off a cliff in sack; and if the man survives the fall down a rocky precipice, he will be hanged. What is your comment on this issue?

Dear brother in Islam, we do really appreciate your question, which shows how far you are interested in getting yourself well-aquatinted with Islam and its teachings. May Allah bless your efforts in the pursuit of knowledge!

 

First of all, it should be clear that this man committed two heinous crimes: 1) homosexuality, and 2) murder. Each crime is sufficient to warrant death penalty. In addition, this man has severed ties of kinship by seducing and killing his nephew.

 

The Glorious Qur’an is explicit in deciding the Hadd (legal penalty) for the crime of murder, when saying: “O ye who believe! the law of equality is prescribed to you in cases of murder: …†(Al-Baqarah: 178)

 

Homosexuality, moreover, is an abomination and a grave sin. In Hadith, the Prophet, peace and blessings be upon him, clarifies the gravity of this abomination by saying: “Allah curses the one who does the actions (homosexual practices) of the people of Lut†repeating it three times; and he said in another Hadith: “If a man comes upon a man then they are both adulterers.†Here, he considered homosexuality tantamount to adultery in relation to the Shari’ah punishments because it is an abomination on the one hand and the definition of adultery applies to it on the other hand.

 

However, death fall is not the sole penalty agreed upon by the Muslim Jurists as a punishment for this crime. The punishment here is controversial due to divergence of views among `Ulama in deducting ruling as regards this case from Shari`ah sources.

Focusing more on the question in point, the eminent Muslim scholar, Sheikh `Abdel Khaliq Hasan Ash-Shareef, states:

 

“As regards this case (if genuine), this man committed two heinous crimes, which deserve severe punishment. He is a murderer and homosexual. Besides, he severed ties of kinship by doing such grave sins.

 

Death penalty (Qisas) is well established by the Qur’an in more than one verse. Allah, Most High, says: “O ye who believe! the law of equality is prescribed to you in cases of murder: …†(Al-Baqarah: 178)

 

As to the issue of how the homosexual person is judged in an Islamic State, the Companions of Prophet Muhammad, peace and blessing be upon him differed among themselves on this issue, and this led to different views maintained by Muslim Jurists. For example, in the Hanafi school of thought, the homosexual is punished through harsh beating, and if he/she repeats the act, death penalty is to be applied. As for the Shafi`i school of thought, the homosexual receives the same punishment of adultery (if he/she is married) or fornication (if not married). This means, that if the homosexual is married, he/she is stoned to death, while if single, he/she is whipped 100 times. Hence, the Shafi`i compares the punishment applied in the case of homosexuality with that of adultery and fornication, while the Hanafi differentiates between the two acts because in homosexuality, the anus (a place of impurity) may also be involved while in adultery (and fornication), the penis/vagina (which are reproductive parts) are involved. Some scholars hold the opinion that the homosexual should be thrown from a high building as a punishment for his crime, but other scholars maintain that he should be imprisoned until death.

 

Based on the above fact, we can conclude that, the judge is invested with full discretion as to whether this man is to be thrown from a high place or not, as a punishment for his crime. However, if the man survives death fall, the judge has the right to sentence him to death.â€

 

Shedding more light on the legal penalty for homosexuality, Dr. Taha Jaber Al-`Alwani, President of the Graduate School of Islamic and Social Sciences and President of the Fiqh Council, states:

 

“The scholars of this Ummah are in agreement - based on what has been revealed in the Qur’an and what has been authenticated in the Prophetic Tradition (Sunnah)- on prohibiting both behaviors (gayness and lesbianism) because in each of two actions there is an assault on the humanity of a person, destruction of the family and a clash with aims of the Lawgiver, one of which is the establishment of sexual instincts between males and females so as to encourage the institution of marriage.

Islam does not view sexual desire as the main aim of marriage; for marriage is a means to acquire tranquility and to actualize the love and mercy between spouses. Furthermore, it is a means for the survival of human kind and fostering a web of sound relations that aid in building sound families that constitute the smallest units for the society at large; this healthy society being the final aim of Islam.

 

Actually, humans are not animals controlled by their sexual instincts, answering the call of sexual desires every time it is aroused in them. Rather, it is their responsibility to know how they can orient this craving, which is a trust Allah has implemented in them, both male and female, in addition to the will and power to choose, a blessing Allah has bestowed on humans; all this is what distinguishes them from the rest of the creatures in that they orient their conduct and do what is good.

 

So, viewing (material) desires as aims in themselves is a deviation from one’s natural disposition and a departure from the natural order. If the trend in the West is to legalize this conduct, it should be noted that such things did not materialize until after religious values had been diluted and had been changed to relative values that glorify individuality and make pleasures as an end and aim.

 

In Hadith, the Prophet, peace and blessings be upon him, clarifies the gravity of this abomination by saying: “Allah curses the one who does the actions of the people of Lut†repeating it three times; and he said in another Hadith: “If a man comes upon a man then they are both adulterers.†Here, he considered homosexuality tantamount to adultery in relation to the Shari’ah punishments because it is an abomination on the one hand and the definition of adultery applies to it on the other hand. It has also been narrated from the Companions (may Allah be pleased with them) that this crime deserves severe punishment more than that of adultery to insure its deterrence and restraint. Verily, the punishment here is the burning of both homosexuals (the actor and acted upon) or stoning them with rocks till death because Allah Most High stoned the people of Lut after demolishing their village.

As for lesbians, the Prophet, peace and blessings be upon him, said about them: "If a woman comes upon a woman, they are both Adulteressesâ€. The scholars mentioned that it is incumbent on the authority to enact a reprimand on lesbians that is fitting to the crime committed.

 

It is true that some of the scholars disagreed with these punishments not because of doubt that these actions constitute a crime, but because of a lack of divine textual stipulation for a worldly punishment. But the actions of the Prophet’s Companions do indicate that in fact this crime has a worldly punishment, to be carried out by those in authority among the Muslims. The story of Abu Bakr Al-Siddiq when Khalid Ibn Al-Waleed wrote to him on this matter is famous and can be referenced in many sources.

This is curious as the upshot of the incident in which Ali burned the transgressors (although I believe it was the zindeeqs, not homosexuals), the Prophet (pbuh) castigated him and stated that fire was the punishment of Allah (swt) alone.

 

With regards to the punishment for homosexuality, there are two camps (dealing with sodomy).

 

One states that it is akin to zina and stoning is the requirement as it falls under the hudud. In this case four upright witnesses are required of penetration or a non-coerced confession repeated thrice.

 

The other states it is a ta'zir (discretionary) punishment, in which case one witness is required and the punishment is not fixed (although it can range up to death in a not nice way, which is usually reserved for treason/sedition).

I've got nothing against Homosexuals and Lesbians. So can someone explain clearly what the problem is. They are human beings, doing stuff privately in their own home. However i agree in Western culture that a tend to date young is occuring, and that it may be wrong for people to choose their sexuality in their teens and pre-teens because they don't know their sexuality yet. But if they decide to be Homosexuals and lesbians, why don't you let them??

The matter of: "If its not harming you what business of yours is it?" tends to rise in matters concerning homesexuality. As llogical said it so comically and to the point

a BIG NO NO for all Abrahaimic religions.

 

Its strange that while you state there be no problem in letting people indulge in homosexuality that it is not quite alright for people to choose their sexuality at a younger age. Again people will say why poke your nose in something that doesn't concern you?

 

Just because something doesn't harm us directly does not automatically mean it should be accepted.

 

The creator commanded us not to practise such thing and as creation it is our duty to follow the command. We were created for a purpose and God knows us better than we know ourselves. Although most of the time us humans have a tendensy to delude ourselves that we know it all.

 

If homosexuality is seen as acceptable now then what? Does one not question as to why male and male or vice versa can't have children naturally? even for those who don't adhere to a religion, why did nature only design so that male and female can reproduce?

 

Furthermore the case of homosexuality and lesbianism is sadly no longer just kept to the privacy of their homes.

There are.

There is a story in Quran about a civilization ( Loot) around west of Egypt in city Called Sodom ( i think that's where Sodomy comes from :D ) any ways...those buggers practiced homoness ( :D i know...not a word :D )..and God sent a prophet to them (prophet LuT)) )and the entire civilization was wiped out by God just because of that. This is mentioned in Quran 7:80, 7:81, 27:54, 27:55.

Plus there is more and Hadiths too :D

We must also see that in the story of Lut, it wasn't simple homosexuality. It was also rape for the purpose of degragation and humiliation, similar to how it is done in prisons. Then they also tried to rape Allahs angel, so simplifing this story to the issue of just homosexuality would be misleading. Honestly, what it comes down to is there is no strong evidence that homosexuality is such and awful sin. And it is indeed a victimless crime, and I think it is just awful that they are persecuted so harshy in so many countries. If you disagree with homosexuality, fine, disagree with it, but mind your buisness. Homosexuality will never, ever, go away. Learn to live with it.

I agree with U...But against divine rationale, nothing really works now does it?

There is substancial evidence against homosexuality backed by other verses from Quran and hadiths..I've heard a hadith where the punishment for homosexuality is as severe as throwing them head first from a cliff (I am not certain if this hadith is reputable though). But like I said...divine rules are written in stone.

Is it because of the great effort of the west to normalize this pervasion. I am already at disgust.

 

If we start from where the written word is: homosexuality is against nature, then we would make progress in understanding. l

et not all the "freedom" claiming, "sexual liberals" jump in defence at the mere statement of; against nature.

 

Rather start with why is homosexuality against nature?

there, here, are many givens if we resort to logic:

 

so if the following sentence is true (True = T),

 

homosexualityt is unatural (T)

 

then

The nature of the person engaged in such an act would find comfort elsewhere (T)

since there is no nature, then there is no love (T)

In the absence of love there is neutrality or hate (T)

An act of passion mandates love or hate (T)

Since the homosexual act is against nature and thus envolves no love, but remains an act of passion, then the emotion driving passion is hate (T)

 

a start .... where is the hate coming from?

and why choose a scenario where the other is unseen?

self hate? revenge conceald as desire? is it narcissism? or simply sadistic?

 

leave this whole media fed propoganda that reduces you to filth, and dare to think. truely think, and not get all hung up and preocuupied with what terminology makes you free.

 

freedom is a feeling from with in, it is not a noun in the Quran as the west has it the most popular over used noun, rather it is used once, and as an adjective.

seem disgusting and wrong. I guess nature is the way the good lord intended things to be. So it makes sense that Humans aren't intended to be homos..Un Natural it must be.. A bit confusing too....bcaz we are not borned with clothing....so perhaps it may be UnNatural to wear them...Or the people who are borned as retards...un natural? Or the Hermaphrodites....Un Natural?

I guess Nature is trickier then it seem.

Maybe whatever doesn't fit inside our belief system is Unnatural..I guess that must be the key in determining what's Natural.

take children without any parental influence who tell them "it's ok honey, you're only a kid" this is a so called sentence of comfort to usually ease a child in to running a round naked. specially on the beach. other signs,

girls pulling down their skirt, at 5, 10, or 15 hardly an action to conceal cottage cheese thighs. try too shy to reveal. covering is natural, open your eyes and observe, but please without all the social conditioning.

Ok..so NATURAL behavior is not what/how God intend things for us..but human tendencies is nature?Commonly acepted behavir?

I'm sorry if I don't get what u mean by Natural behavior....maybe u can define it for me.

Like Human have tendencies to cover up..fine..Humans also have tendencies to lie, the WEST has a tendency to be arrogant right? I mean I'm sure that people have watched THE WEST long enough to say that arrogance is the trend..So it must be natural

then. It's easy to Call people Freaks based on differences...rather difficult to rationalize about that.

being naked is the primary physical state, if we are to assume that what comes out in its primary state needs to be left at its physical prime and thus be called natural then what would fall in to this is a disease infested condition. A simple example is human waste, menstruation, etc.

 

There is the physical natural, and there is the behavioral nature. The behavior would also be known as the instinct. so nature is state and instinct is reaction.

 

Now for the sake of understanding we need go in to definitions.

 

For the so called "liberal" being, the state of nature and the instinct would include the following:

Being naked, the more the better. actually some would even go in to the more you show the more of yourself you accept.

Reacting to what you see as you want. you want to kiss, go kiss. you desire, go seek. you dream, go fulfill.

so what I ask here, if we are to react to nature in the state of nature itself, this would mean when you have a sexual desire, then in the most liberal free claiming thought, you would walk over and seduce instantly. This should also include in the same line of logic, if you have an urge to urinate, you should let go. why bother going to the toilet, just let go, get loose, and let it all hang. "Get in touch with your animal self". a beast one would be.

 

Islam and the other biblical religions have explained this very basic concept to us; that the beast with in, is not original, he is acquired. a satanic self running through, and so there is an extremely fine line between me, myself, and I.

 

There is the soul, the purist of all . It wants is to continuously elevate seeking Allah, a spiritual high in the dictionary of the “liberal”. Besides the soul, there is the ill of 'me' that seeks to keep 'me' on the ground, weighing me down, heavy, chained, and burdened with what ‘I’ wants. 'I' is the satanic influence, at every command it looks to heed convincing me that it is the right thing, the natural thing, bringing out not the human in me but the beast. And that beast mind you is acquired, conditioning to the core to make ‘me’ think it is the natural me, to be an animal.

 

In the contemporary liberal framework, there is no distinguishing. so shallow is the understanding of the self. No wonder there is so much physiological disturbance. Once you see truth, you see the layers, and you search for more. you find behind one action is a stranglehold of reasons, the challenge is to untangle all who have a stake and find the one that is truly me, that which is in accordance with my soul, for it belongs to me while satan is another being.

 

What one might think is nature, most probably would be natural, but not to me to satan. I have another whole set of sophisticated makings, for I am human, not animal.

 

The Islamic teachings take this relation (me, myself, and I) as a focality. Once we understand it truely, and see through the layers, and detect the smallest of whispers, and understand the random thoughts that we have, we would be able to worship Allah freely. My self would be liberated from me, and I.
